For healthcare clients who handle Protected Health Information (PHI), KeyconnectAI offers a HIPAA-compliant service plan as a paid add-on. This includes a Business Associate Agreement (BAA) and ensures that the platform is configured to meet the stringent security and privacy requirements of HIPAA. If you do not subscribe to this plan, you are not permitted to store PHI on the platform.

•Controller: A controller is the entity that determines the purposes and means of processing personal data. The controller decides why and how data is collected and used.
•Processor: A processor is an entity that processes personal data on behalf of the controller. The processor follows the instructions of the controller.
When you use the KeyconnectAI platform, you are the Data Controller. You are in control of the data you upload, what you do with that data, and why. As the controller, you are responsible for ensuring you have a legal basis to process the data and that you comply with all applicable privacy laws.
KeyconnectAI acts as the Data Processor. We process the data on your behalf, according to your instructions and our Terms of Service.
To help you on your compliance journey, we have created the following checklist. These are recommendations for actions you can take both within and outside the KeyconnectAI platform.
1. Right to Be Informed
•Explanation: You must inform your customers how you collect, use, and share their data. This is typically done through a privacy notice.
•What You Can Do in KeyconnectAI: Create a comprehensive privacy notice and link to it on all your funnels, websites, forms, and landing pages built in KeyconnectAI.
•What You Should Do Outside of KeyconnectAI: If you collect customer data offline (e.g., in person or over the phone), you must provide access to your privacy notice during that interaction.
2. Lawfulness of Processing
•Explanation: You must have a valid legal basis to process someone's data, such as their explicit consent or the performance of a contract.
•What You Can Do in KeyconnectAI: Use tags to track the lawful basis for each contact. Create custom fields or consent checkboxes on your forms to document express consent.
•What You Should Do Outside of KeyconnectAI: Maintain clear internal records of your legal bases for processing data. If you are ever audited, you will need to provide proof of compliance.
3. Consent
•Explanation: If you rely on consent, it must be freely given, specific, informed, and unambiguous. You cannot use pre-checked boxes.
•What You Can Do in KeyconnectAI: Add unchecked consent checkboxes to all your forms and funnels. The text should clearly state what the user is consenting to and link to your privacy notice.
•What You Should Do Outside of KeyconnectAI: Keep records of your consent language. If you change your consent forms, save a timestamped version of the old text to prove what users agreed to at a specific time.
4. Right to Erasure (Delete)
•Explanation: Individuals have the right to request that you delete their personal data.
•What You Can Do in KeyconnectAI: You can permanently delete a contact from your KeyconnectAI account. This action is irreversible and will remove all associated data for that contact within the platform.
•What You Should Do Outside of KeyconnectAI: Create a simple internal process for your customers to submit deletion requests (e.g., a dedicated form or email address). Ensure you delete their data from any other systems you use outside of KeyconnectAI.
5. Right to Access & Portability
•Explanation: Individuals have the right to request access to their personal data and receive it in a portable format.
•What You Can Do in KeyconnectAI: You can export a contact's details as a CSV file directly from their contact record in KeyconnectAI. This provides a portable, machine-readable format.
•What You Should Do Outside of KeyconnectAI: Establish a process to handle access requests promptly. If you store customer data in other systems, you must be able to export it from those as well.
6. Right of Rectification
•Explanation: Individuals have the right to have inaccurate personal data corrected.
•What You Can Do in KeyconnectAI: You can easily edit any field in a contact's record within KeyconnectAI to correct inaccuracies upon request.
•What You Should Do Outside of KeyconnectAI: Create a process for customers to submit correction requests. Ensure you update their information across all systems where it is stored.

•Upload or transmit viruses, Trojan horses, or other material that interferes with any party’s uninterrupted use and enjoyment of the Services.

When you use the AI-powered products and features provided by KeyconnectAI, you warrant that you will not:
•Deploy AI techniques that utilize subliminal, manipulative, or deceptive methods designed to distort behavior or impair informed decision-making, particularly when such actions could cause harm.
•Exploit vulnerabilities related to age, disability, or socio-economic circumstances through AI in a way that distorts behavior, especially if it results in significant harm.
•Use AI systems for biometric categorization that infer sensitive attributes such as race, political opinions, religious beliefs, or sexual orientation, except in limited, legally permissible cases.
•Implement AI-based social scoring systems that evaluate or classify individuals or groups in a manner that causes harm, discrimination, or unfair treatment.
•Use AI to infer emotions in sensitive environments such as workplaces or educational institutions where such analysis could lead to discrimination or privacy violations.
•Engage in real-time remote biometric identification in public places for law enforcement purposes, except in specific situations with strong legal justifications and oversight.
Any misuse of our Services or AI Products, or failure to adhere to the standards outlined in this Policy, will result in appropriate actions to ensure the integrity of our platform and the protection of our users. Violations may include, but are not limited to, engaging the AI Products in ways that violate user privacy, manipulate data, or disregard ethical guidelines.
Depending on the nature and severity of the violation, we may take one or more of the following actions:
•Warnings: The responsible party may receive a formal warning.
•Temporary Suspension: Access to the Services or certain features may be temporarily suspended.
•Termination of Access: Serious or repeated violations may lead to the permanent termination of your account and access to our Services.
•Legal Action: In cases where misuse leads to significant harm, data breaches, or legal violations, we may pursue legal action and report the incident to law enforcement or regulatory bodies.
"Contributions" refer to any data, information, text, code, graphics, photos, videos, or other materials that you post, upload, or otherwise provide on or through the Services. You are solely responsible for your Contributions and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.
